1. Introduction and Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of the services provided by Northern WildCare Rescue Ltd. (the “Company,” “we,” “us,” or “our”), a wildlife-rescue business operating in Canada. By contacting us, booking services, permitting us to attend your property, or otherwise using our services, you confirm that you have read, understood, and agree to be bound by these Terms, together with any written estimate, service agreement, invoice, work order, or other terms expressly agreed in writing by the Company.

If you do not agree to these Terms, you must not use our services. If you are accepting these Terms on behalf of another person or entity, you represent and warrant that you have authority to bind that person or entity.

2. Scope of Services

Northern WildCare Rescue Ltd. provides wildlife-related services, which may include any of the following, subject to applicable law, permits, seasonal conditions, and site-specific limitations:

Our services are intended to promote humane wildlife management and property protection. We do not guarantee that wildlife will be permanently excluded, that damage will be fully prevented, or that all entry points, infestation sources, or animal activity will be discovered during any inspection.

All services are subject to compliance with applicable federal, provincial, and municipal laws in Canada, including wildlife protection, animal welfare, public safety, and environmental requirements. Where a service requires a permit, authorization, specialized conditions, or third-party consent, the service may be delayed, modified, or declined.

3. User Obligations and Responsibilities

By engaging our services, you agree to:

You acknowledge that wildlife work is inherently variable and may involve unpredictable animal behavior, concealed damage, odors, waste, parasites, and health or safety risks. You are solely responsible for maintaining the property in a condition suitable for service and for addressing unrelated structural, electrical, roofing, ventilation, sanitation, or building-code issues.

4. Payment Terms and Conditions

Fees for services may be set out in a quote, estimate, service order, or invoice provided by the Company. Unless otherwise stated in writing:

You are responsible for all applicable taxes, including GST/HST and any other taxes required by law, unless otherwise stated. If a payment is reversed, disputed without valid basis, or returned for insufficient funds, you may be responsible for any associated banking fees, administrative charges, and recovery costs to the extent permitted by law.

5. Cancellation and Refund Policy

You may cancel a scheduled appointment by contacting us as soon as possible using the contact information below. Cancellations made with reasonable notice may not be subject to a fee, unless a deposit has been paid or materials, permits, travel, or special scheduling arrangements have already been incurred.

Because wildlife services often require immediate mobilization, specialized labor, and site-specific preparation, refunds are limited and assessed case by case. Unless otherwise required by applicable consumer protection law or expressly agreed in writing:

Nothing in these Terms limits any mandatory rights you may have under applicable law, including consumer protection rights that cannot be waived by contract.

6. Liability Limitations

To the fullest extent permitted by applicable law, Northern WildCare Rescue Ltd. shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of use, loss of revenue, loss of profit, loss of business, loss of goodwill, or loss arising from delay, wildlife re-entry, structural defects, pre-existing conditions, or acts or omissions of third parties.

Without limiting the foregoing, we are not responsible for:

Our total aggregate liability arising out of or relating to the services or these Terms, whether in contract, tort, negligence, strict liability, or otherwise, shall be limited to the amount actually paid by you to the Company for the specific service giving rise to the claim, except where such limitation is prohibited by law.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for gross negligence, wilful misconduct, or bodily injury caused by the Company where such limitation would be unlawful.

10. Changes to Terms

13. Severability Clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or other competent authority, that provision shall be interpreted, limited, or severed to the minimum extent necessary so that the remaining provisions remain in full force and effect. If severance is not possible, the invalid provision shall be deemed removed, and the remainder of these Terms shall continue to apply.
